Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GigaRizz iOS app and related services (the "Service") provided by GigaRizz ("we", "us", "our"). By using the Service you agree to these Terms.

1. Eligibility

You must be at least 17 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. You must have the legal capacity to enter into a binding contract.

2. Your Account

You authenticate via Apple Sign-In. You are responsible for activity under your account. Notify us immediately at support@gigarizz.app if you suspect unauthorized access.

3. Acceptable Use

You agree NOT to:

• Upload photos of other people without their explicit, informed consent.
• Upload photos of minors (any person under 18) for any purpose.
• Generate sexual, nude, or sexually-suggestive content of any person, including yourself.
• Generate content designed to impersonate, defame, harass, or deceive others.
• Generate content depicting real public figures, celebrities, or politicians without authorization.
• Use the Service for non-consensual intimate imagery, deepfakes, identity theft, or fraud.
• Reverse-engineer, scrape, or attempt to extract source code, models, or weights.
• Bypass content moderation, rate limits, or any access controls.
• Resell, sublicense, or commercially redistribute generated content as a stock photo service.

We reserve the right to remove content, suspend, or terminate accounts that violate these rules. CSAM (child sexual abuse material) will be reported to NCMEC and law enforcement.

4. Content Ownership and License

4.1 Your photos

You retain all rights to photos you upload. By uploading, you grant us a limited, non-exclusive license to:

• Transmit your photos to AI providers (Replicate, fal.ai, OpenAI) to fulfill your generation request.
• Store your photos in our cloud storage to deliver and persist generated outputs.
• Display your photos and generations back to you within the Service.

This license terminates when you delete the photo or your account. We do not use your photos to train AI models.

4.2 Generated photos

You own the AI-generated photos produced from your source photos, subject to the underlying AI providers' terms. You are responsible for ensuring your use of generated photos complies with applicable law.

4.3 AI content disclosure

You acknowledge that photos generated by GigaRizz are AI-generated, not real photographs. When using generated photos in dating profiles or social media, you agree to comply with each platform's AI content disclosure rules.

5. Subscriptions and Payments

5.1 Plans

• Free — limited number of generations per period.
• Plus — weekly or monthly subscription with expanded generation quotas.
• Gold — monthly or annual subscription with effectively unlimited generations and premium features (Hinge Mode, GPT Image 2, Pose Studio).

5.2 Auto-renewal

Paid subscriptions automatically renew at the end of each period unless cancelled at least 24 hours before the renewal date. Manage and cancel subscriptions in your iOS device's Settings → Apple ID → Subscriptions.

5.3 Refunds

All purchases are processed through Apple's App Store. Refund requests are handled by Apple per their refund policy at reportaproblem.apple.com.

5.4 Free trials and intro offers

If your account qualifies for a free trial or intro offer, you must cancel before the trial period ends to avoid being charged.

6. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. AI generation is probabilistic — outputs may not match your expectations and may contain artifacts. Match rate, attractiveness, or dating success outcomes are not guaranteed.

7. Limitation of Liability

To the maximum extent permitted by law, GigaRizz and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless GigaRizz from claims arising out of your violation of these Terms, your violation of law, or content you submit to the Service.

9. Termination

We may suspend or terminate your access for violating these Terms, for legal reasons, or to wind down a feature. You may stop using the Service at any time and delete your account from Settings.

10. Changes to the Service or Terms

We may modify or discontinue features at any time. We may update these Terms; material changes will be communicated in-app or by email. Continued use after the effective date constitutes acceptance.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved by binding arbitration on an individual basis (no class actions) under the rules of the American Arbitration Association, except for small-claims court actions and injunctive relief.
